In the event of a conflict between the Cloud VPS Hosting Agreement and the Universal Terms of Service, the Universal Terms of Service will control.

With VPS Hosting, each customer can run their own virtualized operating system within a partition of a dedicated server. Even though multiple customers are on the same physical machine, VPS Hosting allows each customer’s account/website to have all the capabilities of being on their own separate server. InMotion Hosting’s Cloud VPS Hosting comes with a number of additional features including high-availability, Live-State and Scheduled snapshots, resource monitoring, free solid-state drives (SSDs), Choice of Linux OS: CentOS, Ubuntu, or Debian, burstable RAM, unlimited MySQL databases, email accounts and FTP accounts, root access and SSH access.

In order to ensure that our customers do not experience an interruption or loss of services, all the services that InMotion Hosting offers are setup on automatic renewal. Automatic renewal renews the applicable service upon expiration of the then current term for a renewal period equal in time to the most recent service period. Renewals will be charged at the current rate for the service being renewed.
Renewals will happen on the date listed in the Account Management Panel(AMP), with the exception of domain registrations and Secure Socket Layer(SSL) renewal, which both renew two weeks prior to the date listed to ensure payment can be processed and registration renewed in a timely manner to avoid service interruption.
For most services, the auto-renewal can be turned off in the AMP but must be done prior to the renewal date for the service. Hosting plans auto renewals must be turned off by reaching out to our Customer Service Team. If the auto-renewal is turned off, payments must be made in the AMP by the renewal date to avoid service interruptions.
To cancel your account, or turn off auto-renewal please contact our Customer Service Department at any time. We recommend calling us at 888-321-4678 ext 4 (US customers) or +1-757-416-6575 ext 4 (international customers) as the fastest method, followed by chat, and then creating a ticket if necessary.
The services may also be cancelled by either the customer or InMotion Hosting by giving the other party thirty (30) days prior written notice. Cancellation is subject to an early cancellation fee payable by the customer.
The Company, at any time, without notice, if, in InMotion Hosting’s sole and absolute discretion, the customer is in violation of any term or condition of the Terms of Service or any related agreements, Authorized User Policy, or the customer’s use of the services to disrupt or, in InMotion Hosting’s sole and absolute discretion, could cause disruption of InMotion Hosting’s business operations.

InMotion Hosting offers, as an optional service to its clients, an automated backup solution (“Backup Manager”) for an additional service charge. Backup Manager will provide regular automated data backups on accounts equal to or less than 10 gigabytes in total size. Additional backup space for Backup Manager is available for an additional service charge. InMotion Hosting is not responsible for monitoring account size. Accounts exceeding the backup limit to which a customer subscribes will not be included in regular data backups.
While InMotion Hosting maintains the previously stated backups for clients choosing to subscribe to Backup Manager, InMotion Hosting assumes no liability as to the availability or completeness of client data backups. Each client is expected and encouraged to maintain backup copies of their own data. Backup Manager is a non-refundable subscription but can be cancelled any time.
Upon Cancellation or Suspension for nonpayment, all data is purged from the server.
As part of the Cloud VPS Hosting plans, a number of IPs are assigned to the customer. The assigned IP address(es) are for the customer’s use, the right to use that IP address shall belong only to InMotion Hosting. The customer shall have no right to use that IP address except as permitted by InMotion Hosting’s Terms of service.
InMotion Hosting, shall maintain and control ownership of all Internet Protocol numbers and addresses that have been assigned to the customer, and InMotion Hosting reserves the right to change or remove any and all such Internet Protocol numbers and addresses, in its sole and absolute discretion.
Higher levels of traffic will incur overcharges on a monthly basis. However, the rates for bandwidth usage are lower for IMH than for any other services we offer. IMH provides full access to web reports for network traffic monitoring and reporting. IMH also provides graphs that show customers’ monthly usage, which is the average rate and reflects the amount of bandwidth transferred during the month. The bandwidth charges reflects the average monthly bandwidth in Kilobits per second (Kbps) and in Gigabyte(GB)/month. These charges reflect our expenses in network maintenance, upgrades, backbone port charges, leased line loops, and equipment.
Our Cloud VPS product line is for technically advanced clients who have experience in configuring, securing/maintaining servers and do not require the basic technical support services of the web hosting provider. The support we would provide for a Cloud VPS is to ensure the VPS itself has power & connectivity to the internet and you have established access in the method we provisioned the VPS. Unfortunately, our Support department is unable to provide any support for any applications running on a Cloud VPS. However, we do provide additional tools via your Account Management Panel including SSH Key Management, DNS Management, Flush Firewall Rules, a Re-OS tool as well as Snapshot functionality.

In addition to the Cloud VPS responsibilities, if you were unable to perform these yourself, you can utilize a 3rd party server management company or hire a Systems Administrator to manage your server. This department, due to their skill set is a paid service and is available via renewing contracts monthly or A La Carte for individual tasks.
